I have read the below and agree to the terms of this Agreement as of the date of acknowledgement.
This Short-Term Rental Agreement Terms and Conditions (the "Agreement") are hereby agreed to you as of the date of
acknowledgement.
The property owner has agreed to provide you with use and access to the property located at 8878 Pear Ave., Newaygo, MI 49337 and is located on Bills Lake in Newaygo, Michigan (the “Property”) for the rental period identified in your reservation for the Property.
In connection with your use and access to the Property, you agree to the following terms and conditions:
1. Rental Period: The rental period shall commence on 4 PM ET on the first date identified in your reservation and end on 11 AM ET on the last date identified in your reservation (the “Rental Period”).
2. Rental Payment: You agree to pay the total amount identified in your reservation in accordance with the payment terms identified in your reservation.
3. Occupancy: The Property is suitable for a maximum of seven (7) occupants.
4. Rental Rules and Regulations:
a. You agree to comply with (i) all applicable laws and regulations and (ii) the Bills Lake Water Safety Rules set forth on Exhibit A attached hereto.
b. Check in is after 4:00 PM ET. Check out is before 11 AM ET. A code will be provided for self-check in.
c. You will not engage in any illegal activities on the Property.
d. Smoking is strictly prohibited inside the Property.
e. Pets are not allowed unless explicitly permitted by the property owner in writing.
f. You will be responsible for maintaining the cleanliness of the Property and will leave it in the same condition as
it was found.
g. Quiet hours are from 10:00 PM ET to 7:00 AM ET
h. No parties or events are allowed on the Property.
i. No commercial photography or videography is allowed on the Property.
j. You will be liable for any damages caused to the Property or its contents during the rental period, beyond
normal wear and tear.
k. The property owner is not responsible for any injuries or accidents that occur on the Property during the rental
period.
5. Cancellation and Refunds:
a. If you wish to cancel the reservation, a written notice must be provided to the property owner. The following
cancellation policy will apply: (i) Cancellation 30 days or more prior to the check-in date: 100% refund of the
total rental fee. (ii) Cancellation 15 to 29 days prior to the check-in date: 50% refund of the total rental fee. (iii)
Cancellation less than 15 days prior to the check-in date: No refund will be provided.
b. In the event that the property owner is unable to provide the rental property as agreed (e.g., due to unforeseen
circumstances or damages), you will be entitled to a full refund.
6. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws
of the State of Michigan. Any legal action arising out of or in connection with this Agreement shall be brought
exclusively in the state or federal courts located in the County of Kent, Michigan.
7. Entire Agreement: This Agreement constitutes the entire understanding between you and the property owner, and
supersedes all prior agreements, oral or written, relating to the short term rental of the Property or any activities
contemplated herein.
INTENDING TO BE LEGALLY BOUND, you have agreed to the terms of this Agreement as of the date of acknowledgement.
EXHIBIT A BILLS LAKE WATER SAFETY RULES

I have read the below and agree to the terms of this Agreement as of the date of acknowledgement.
• NO-WAKE between the hours of 7:30pm and 11:00am.
• There is no swimming, wading, or fishing at the boat launch.
• Children under 6 years of age must wear a Type I or II USCG-approved PFD when riding on the open deck of any vessel while underway.
• Every vessel towing a person(s) while on tubes, wakeboards, water skis, etc. must have a person on board, in addition to the vessel operator, observing the towed person(s) at all times.
• A USCG-approved Type I, II, or III PFD must be worn by every person being towed behind a vessel on tubes, water skis, surfboard, etc.
• PWC operators must properly attach the Emergency Engine Cut-Off Switch lanyard between themselves and the PWC.
• Stay at least 100 feet of: docks, rafts, shoreline, person in the water and anchored/moored vessel (fishing boat) while traveling at speeds faster than no-wake.
• Reasonable and prudent operation of all PWC must be maintained at all time. It is illegal to:
• Jump the wake of another vessel unnecessarily close to the other vessel.
• Cross within 150 ft. behind another vessel other than another PWC if operating at greater than no-wake speed.
• Chasing, harassing or disturbing wildlife with any vessel is prohibited.
• Speeds in excess of 55mph are illegal on Bills Lake.
• Travel in a counterclockwise direction around the perimeter of the lake.
• It is Michigan law (2019), a person shall not launch or transport watercraft or trailers unless free of aquatic organisms, including plants.
